If a property is rented, start by reviewing the tenancy agreement, the sale timetable and who will communicate with the tenant. An owner can plan the campaign without treating the premises as vacant.

Before photography and viewings

The RTA says a Notice of lessor’s intention to sell premises (Form 10) must be issued before or with an Entry notice when showing the property to a prospective buyer. Its general tenancy rules describe 48 hours’ notice for entry to show a purchaser. An open house or on-site auction requires the tenant’s written agreement.

Advertising photos that show a tenant’s possessions require the tenant’s written agreement. Discuss the proposed imagery before booking a photographer and keep the agreement with the campaign records.

Owner’s planning checklist

  • Confirm the tenancy type, agreement dates and current property manager.
  • Plan how the tenant will be informed and how access requests will be made.
  • Agree the photography approach before using images of occupied rooms.
  • Prepare property and building information relevant to the sale.
